• On Friday 13th January the High Court started to hear DECC's application to appeal against the pre-Christmas court ruling that their announcement of the reduction in the feed-in tariff was "legally flawed". It would appear that far from coming to a conclusion, the court didn't even get as far as deciding if the appeal could be heard, let alone hearing the appeal.

• DECC have issued a statement on the outcome of the day in court.
• The appeal court still first needs to decide if DECC will be granted leave to appeal and if so there will be an appeal hearing. There is no fixed time set yet for either their decision on hearing the appeal or when any appeal hearing would be, but it would seem likely now to be late January - early February before any final result.
• The REAL Assurance Scheme administrators have put a short statement from DECC on their web site confirming that "the tariff rate for PV installations less than or equal to 4kW will not fall below 21p for installations with an eligibility date between 12th December 2011 and 31st March 2012".
• There were 422 registered installations of solar PV systems in the first week of 2012 for people who are willing to go ahead assuming they will receive the DECC announced rate of 21p per kWh from 1st April onwards. That is a similar run rate to early Jan 2011 and we would expect to see that rate rapidly rise up to 1,000 per week and beyond.
• There are multiple sources of independent news regarding the on-going developments including The Solar Power Portal and Click Green.
• Nobody knows the final outcome of the appeal process or the review of the feed-in tariff itself, but DECC are clearly determined to make the rate for domestic scale solar PV installations 21p and not 43p, and irrespective of the outcome of the appeal process, it's only a matter time before that becomes confirmed.
The PV market in the UK (at 21p per kWh) is continuing, and reports of it's death have been greatly exaggerated. Quality installation businesses with a good sales and marketing process are continuing to thrive.

CHANCELLOR OF THE EXCHEQUER GIVES THE RHI THE GREEN LIGHT!!!

The Government has confirmed that the RHI will go ahead next June although reduced in scope by 20% and paid for directly by the Treasury. Exactly what impact these changes will have on the scheme as published within the consultation document remain to be seen and we are unlikely to know before the Government's response to the consultation is published - date tbc!
